Terms of Service

1. Agreement to Terms
These Terms of Service ("Terms") are a legally binding agreement between you ("you", "your", or "User") and Sonce Studio d.o.o., registration number (matična številka): 9724575000, tax number (davčna številka): 97200034, registered in Slovenia, with its registered address at Ljubljanska cesta 11, 4220 Škofja Loka, Slovenia, operating the Yachtie product on behalf of its founder ("we", "us", "our", or "Yachtie").
Yachtie is a product created and owned by Jure Kovač. Sonce Studio d.o.o. provides the operational, technical, and publishing infrastructure for the Yachtie mobile application and the yachtie.co website (collectively, the "Service") under arrangement with the product owner. In the event that a dedicated Yachtie entity is established, all rights and obligations under these Terms will transfer to that entity, and you will be notified of the change.
By creating an account, accessing, or using Yachtie, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the Service.
2. Eligibility
To use Yachtie, you must:
- Be at least 18 years of age. By using the Service, you represent and warrant that you are 18 or older. Yachtie is a professional networking platform for the yachting industry, and we do not knowingly allow use by anyone under 18.
- Not be prohibited from using the Service under any applicable law or regulation.
- Be a genuine yachting industry professional, crew member, captain, employer, or maritime enthusiast.
We reserve the right to request verification of your age or professional status at any time and to suspend or terminate accounts that do not meet these eligibility requirements.
3. Your Account
Registration. To access most features of Yachtie, you must create an account using a valid email address or Apple Sign-In. You agree to provide accurate, current, and complete information during registration and to keep your profile information reasonably up to date.
One account per person. Each individual may maintain only one Yachtie account. Creating multiple accounts may result in suspension or termination of all associated accounts.
Account security. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at hello@yachtie.co if you suspect any unauthorised use of your account.
Account accuracy. You must not impersonate any other person or misrepresent your identity, qualifications, or affiliations. Professional information — including certifications, vessel assignments, and employment history — must be truthful and accurate to the best of your knowledge.
4. How Yachtie Works
Yachtie is a professional networking platform for the yachting industry. The Service enables you to:
- Create a professional profile showcasing your experience, certifications, and qualifications.
- Connect with other crew members, captains, and maritime professionals.
- Share your location with friends to find nearby crew (with your explicit permission).
- Upload and share your CV with potential employers.
- Communicate with other users through direct messaging.
- Discover and attend social events ("Hangouts") organised by the community.
- Make yourself visible to potential employers as available for work (dockwalking/daywork).
- Store and manage your professional references and vessel assignment history.
5. Acceptable Use
You agree to use Yachtie in a lawful, respectful, and professional manner. You agree not to:
- Impersonate others or misrepresent your identity, qualifications, certifications, or employment history.
- Post false, misleading, or fraudulent information, including fabricated vessel assignments or professional credentials.
- Harass, stalk, bully, or threaten other users, whether through messages, profile content, or any other means.
- Send spam or unsolicited commercial messages to other users.
- Scrape, harvest, or collect user data, profile information, or any other content from the Service by automated or manual means.
- Attempt to circumvent security measures, access controls, or row-level security policies.
- Use the Service for any illegal purpose, including but not limited to human trafficking, smuggling, or any activity that violates maritime law.
- Upload malicious content, including viruses, malware, or any software designed to disrupt the Service.
- Post content that violates the intellectual property rights, privacy rights, or other rights of any third party.
- Share another person's personal information (such as reference contact details) without their express permission.
- Reverse engineer, decompile, or disassemble any part of the Service.
- Create accounts for the purpose of violating these Terms or circumventing account suspension.
We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates these Terms, including removing content, issuing warnings, suspending accounts, or permanently terminating access.
6. Your Content
Ownership. You retain full ownership of all content you submit, post, or upload to Yachtie, including your profile information, photos, CVs, messages, and any other materials ("Your Content").
Licence grant. By uploading or posting Your Content to Yachtie, you grant us a non-exclusive, worldwide, royalty-free, sublicensable licence to use, display, reproduce, and distribute Your Content solely for the purpose of operating and providing the Service. This licence is limited to what is necessary to make your content visible to other users in accordance with your privacy settings and the functionality of the platform. This licence terminates when you delete Your Content or your account, except where Your Content has been shared with other users (such as messages) and is retained in anonymised form as described in our Privacy Policy.
Responsibility. You are solely responsible for Your Content. You represent and warrant that you have all necessary rights and permissions to upload and share Your Content, and that Your Content does not violate any applicable law or the rights of any third party.
CV and professional documents. When you upload your CV or other professional documents, you understand that these may be shared with potential employers (such as captains and heads of department) on the platform, subject to your visibility settings. You can control who can access your CV and view a log of who has accessed it.
Reference contacts. When you add reference contacts (name, email, phone number) to your vessel assignments, you confirm that you have obtained the reference's permission to share their contact details with potential employers on Yachtie.
Content removal. We reserve the right, but are not obligated, to review, moderate, and remove any content that violates these Terms or that we find objectionable, at our sole discretion and without prior notice.
7. Location Services
Yachtie offers optional location-based features, including the ability to see nearby crew and make yourself discoverable to friends or potential employers.
Consent-based. Location sharing is entirely optional and requires your explicit permission. You can choose to share your location with friends only, or keep it completely hidden. Location sharing defaults to off and must be actively enabled by you.
Safety measures. To protect your privacy, Yachtie does not share your precise location with other users. Your displayed location is approximated (spoofed) to roughly a 1-kilometre radius. Only confirmed friends can see your location when you have location sharing set to "Friends only."
Dockwalking and daywork. If you enable dockwalking/daywork availability, potential employers (captains and heads of department) can see that you are available for work and your approximate distance — but not your exact location. This feature is separate from friend-based location sharing and defaults to off.
Control. You can change your location sharing preferences at any time in the app's Settings. Disabling location sharing takes effect immediately.
8. Employer Verification
Captains, heads of department, and other employer-side users may undergo a verification process that includes providing their name, role, WhatsApp contact, CV, and a government-issued ID document.
ID document handling. ID documents submitted for verification are stored securely with encryption at rest, accessible only to a small, trained internal team. Your ID document is automatically deleted within 30 days of verification (or rejection). Only a "verified" status flag is retained after deletion. ID documents are never shared with other users or third parties.
By submitting an ID document, you acknowledge and consent to this verification process as described above and in our Privacy Policy.
9. Professional Networking Disclaimer
Yachtie is a platform for professional networking and connection within the yachting industry. It is important that you understand the following:
- Yachtie is not an employment agency, recruiter, or staffing service. We facilitate connections between professionals but do not act as an employer, agent, or intermediary in any employment relationship.
- No guarantee of employment. We do not guarantee that using Yachtie will result in employment, job offers, contracts, or any professional opportunities.
- No credential verification. While employer-side users may undergo identity verification, Yachtie does not independently verify the accuracy of users' certifications, qualifications, references, or employment history. You are responsible for conducting your own due diligence before entering into any professional arrangement.
- No endorsement. The presence of a user, vessel, or organisation on Yachtie does not constitute an endorsement, recommendation, or guarantee by Yachtie.
- Your responsibility. Any hiring decisions, employment agreements, or professional arrangements are made solely between the parties involved. Yachtie bears no responsibility for the outcome of any such arrangements.
10. Employer-Side Users (Captains, Heads of Department, and Hiring Managers)
If you use Yachtie in the capacity of an employer, captain, head of department, or hiring manager to discover crew, review CVs, or verify professionals, the following additional terms apply to you:
Independent data controller. When you access, review, or download a crew member's CV, profile information, or reference contacts for the purpose of making hiring or employment decisions, you act as an independent data controller for that data under applicable data protection law (including the GDPR). You are responsible for your own lawful processing of any personal data you obtain through Yachtie, including ensuring you have an appropriate legal basis for processing it and handling it in accordance with your own obligations under data protection law.
Permitted use. You may use personal data obtained through Yachtie solely for legitimate hiring, employment verification, and crew management purposes related to the yachting industry. You may not use such data for any other purpose, and you may not share it with third parties except as strictly necessary for the hiring process (e.g., sharing a crew member's CV with a yacht management company you represent).
CV access logging. All access to crew members' CVs is logged. Users can see who has viewed their CV and when. You acknowledge and consent to this logging when you access another user's CV.
Verification obligations. If you undergo employer verification, you must provide truthful and accurate information. Providing false information during the verification process may result in immediate suspension or termination of your account.
No scraping or bulk collection. You may not systematically collect, download, or export user profiles, CVs, or contact information from Yachtie for use outside the platform, including for building candidate databases, mailing lists, or for any commercial purpose unrelated to a specific, active hiring need.
11. Communications and Emails
Transactional emails. By creating an account, you agree to receive transactional emails from us that are necessary for the operation of the Service, such as sign-in links, account verification, security alerts, and account deletion confirmations. You cannot opt out of transactional emails while your account is active, as they are essential to the Service.
Marketing and promotional emails. With your explicit consent, we may send you product updates, newsletters, feature announcements, and other promotional communications. You can opt in to marketing emails during onboarding or in the app's Settings, and you can unsubscribe at any time using the unsubscribe link in any marketing email or by adjusting your preferences in Settings. We will never send marketing emails without your opt-in consent.
Push notifications. With your permission (granted via iOS system prompt), we may send push notifications about activity such as friend requests and, as we add features, messages and other updates. You can manage push notification preferences in the app's Settings or through your device's iOS Settings at any time.
12. Privacy
Your use of Yachtie is subject to our Privacy Policy, which explains how we collect, use, store, and protect your personal data. The Privacy Policy is incorporated into these Terms by reference. By using Yachtie, you acknowledge that you have read and understood our Privacy Policy.
13. Intellectual Property
Yachtie's property. The Service — including its design, logos, brand elements, software, features, and all original content (excluding User Content) — is the intellectual property of Jure Kovač (the product owner) and is protected by copyright, trademark, and other intellectual property laws. Sonce Studio d.o.o. operates the Service under licence from the product owner. You may not copy, modify, distribute, sell, or lease any part of the Service without express written permission from the product owner.
Trademarks. "Yachtie", the Yachtie logo, and related brand elements are trademarks of Jure Kovač / Yachtie. You may not use these marks without prior written consent.
Feedback. If you provide us with suggestions, feedback, or ideas for improvements to the Service, you grant us the right to use such feedback without restriction or compensation.
14. Third-Party Services
Yachtie integrates with and relies on certain third-party services to provide its functionality, including Apple Sign-In for authentication, Supabase for data infrastructure, PostHog for usage analytics, and Tally for early access sign-up forms on our website. Your use of these third-party services is subject to their respective terms and privacy policies. Yachtie is not responsible for the practices, content, or availability of any third-party service.
The Service may contain links to third-party websites or resources. We provide these links for convenience only and do not endorse or assume responsibility for any third-party content.
15. Disclaimers
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YACHTIE DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.
WITHOUT LIMITING THE FOREGOING, YACHTIE DOES NOT WARRANT THAT:
- THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
- THE INFORMATION PROVIDED BY OTHER USERS (INCLUDING PROFESSIONAL QUALIFICATIONS, CERTIFICATIONS, AND REFERENCES) IS ACCURATE, COMPLETE, OR RELIABLE.
- THE SERVICE WILL MEET YOUR SPECIFIC REQUIREMENTS OR EXPECTATIONS.
- ANY DEFECTS IN THE SERVICE WILL BE CORRECTED.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YACHTIE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:
- YOUR USE OF, OR INABILITY TO USE, THE SERVICE.
- ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE.
- ANY CONTENT OBTAINED FROM THE SERVICE.
- UNAUTHORISED ACCESS, USE, OR ALTERATION OF YOUR CONTENT OR DATA.
IN NO EVENT SHALL YACHTIE'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF: (A) ONE HUNDRED EUROS (EUR 100); OR (B) THE TOTAL AMOUNT YOU HAVE PAID TO YACHTIE FOR PAID FEATURES, IF ANY, IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM. FOR FREE USERS WHO HAVE NOT MADE ANY PAYMENTS, THE MAXIMUM AGGREGATE LIABILITY SHALL BE ONE HUNDRED EUROS (EUR 100).
NOTHING IN THESE TERMS SHALL EXCLUDE OR LIMIT LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, FRAUD OR FRAUDULENT MISREPRESENTATION, OR ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
17. Indemnification
You agree to indemnify, defend, and hold harmless Yachtie and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:
- Your use of the Service or violation of these Terms.
- Your Content, including any claim that Your Content infringes the rights of a third party.
- Your violation of any applicable law or regulation.
- Any misrepresentation regarding your qualifications, certifications, or professional status.
- Your sharing of third-party personal information (such as reference contacts) without proper authorisation.
18. Termination
By you. You may delete your account at any time through the app's Settings. Account deletion is processed immediately. Upon deletion, your profile will be anonymised and your personal data will be handled as described in our Privacy Policy. We may in the future introduce an optional grace period before final deletion to allow you to change your mind; if we do, we will update these Terms accordingly.
By us. We may suspend or terminate your account at any time, with or without cause, and with or without notice, if we reasonably believe that you have violated these Terms, engaged in conduct that is harmful to other users or the Service, or for any other reason at our sole discretion.
Effect of termination. Upon termination, your right to use the Service immediately ceases. Sections of these Terms that by their nature should survive termination shall survive, including but not limited to Sections 6 (Your Content — licence grant for previously shared content), 9 (Professional Networking Disclaimer), 10 (Employer-Side Users), 15 (Disclaimers), 16 (Limitation of Liability), 17 (Indemnification), and 20 (Governing Law).
Data after termination. Following account deletion, your data is handled in accordance with our Privacy Policy. In summary, your profile information is deleted or anonymised, your media and CVs are permanently deleted, and messages you sent are retained in anonymised form to preserve conversation continuity for other users.
19. Changes to These Terms
We may update these Terms from time to time to reflect changes in our Service, legal requirements, or business practices. When we make material changes, we will notify you by posting the updated Terms on this page with a revised "Last updated" date. For significant changes, we may also notify you via email or through an in-app notification.
Your continued use of the Service after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you should stop using the Service and delete your account.
20. Governing Law and Disputes
These Terms shall be governed by and construed in accordance with the laws of the Republic of Slovenia, without regard to its conflict of laws provisions.
Any dispute arising out of or in connection with these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within 30 days, it shall be submitted to the exclusive jurisdiction of the courts of Ljubljana, Slovenia.
Nothing in this section shall prevent either party from seeking injunctive or other equitable relief in any court of competent jurisdiction.
If you are a consumer in the European Union, you retain any mandatory consumer protection rights afforded to you by the law of your country of residence, and you may bring proceedings in your local courts.
21. General Provisions
Entire agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Yachtie regarding the Service and supersede all prior agreements and understandings.
Severability. If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
Waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
No third-party beneficiaries. These Terms do not create any third-party beneficiary rights.
